The TKS Group Cloud Services Acceptable Use Policy

1. Introduction

This Acceptable Use Policy (AUP) is designed to help you use the products, services, and equipment provided by The TKS Group (“Services”) while ensuring that you understand the policies and procedures developed to comply with applicable laws and regulations. All users of The TKS Group Services must adhere to this AUP. This AUP is incorporated into all agreements, including Master Service Agreements, Service Level Agreements, and Statements of Work. Your continued use of our Services constitutes acceptance of the most current version of this AUP. It is your responsibility, and a contractual obligation, to ensure that your affiliates, agents, and clients (End Users) comply with this AUP at all times.

2. Modifications to the AUP

Due to the dynamic nature of the Internet and cloud/web services, The TKS Group reserves the right to update or modify this AUP at any time without notice. While this AUP outlines typical unacceptable activities, it may not list every possible scenario. We reserve the right, in our sole discretion, to determine what constitutes unacceptable behavior.

3. Notices and Reporting Violations

If you become aware of any violation of this AUP, please notify us immediately at [abuse@thetksgroup.com] (or your designated contact) and assist with any investigation. All reports must include a valid, working email address, phone number, and your full name. Anonymous complaints will not be considered.

4. Suspension, Termination, and Service Fees

The TKS Group reserves the right to suspend or terminate the Services—at our sole discretion and with or without notice—if any user (or their affiliates, agents, or clients) violates any provision of this AUP. Any suspension or termination due to an AUP violation will not warrant a refund for services already rendered. The TKS Group is not liable for any damages arising from the exercise of our rights under this AUP.

5. Monitoring and Enforcement

We reserve the right to monitor network activity to ensure compliance with this AUP and to investigate any suspected violations. We may report any activity that appears to contravene applicable laws or regulations to law enforcement, regulatory authorities, or other third parties as appropriate. Cooperation with such investigations is expected from all users.

6. Content Responsibility

The TKS Group does not review, edit, or control the content created, stored, or transmitted using our Services. As such, we are not liable for any damages or liabilities arising from the use or misuse of content by users, agents, or third parties.

7. Prohibited Content

Users must not use The TKS Group Services to transmit, store, display, or otherwise make available any content that is illegal, harmful, fraudulent, offensive, or that infringes on the intellectual property or proprietary rights of others. This includes but is not limited to content that is obscene (including child pornography), defamatory, libelous, threatening, abusive, hateful, or excessively violent.

8. Prohibited Use

The Services must be used only in ways that comply with all applicable laws and regulations. Specifically, you may not use or facilitate the use of our Services to:

Violate export control laws or any other applicable regulations.
Affect the stability, security, or performance of our Services or those of our clients.
Expose The TKS Group or its users to criminal or civil liability.
Forge, misrepresent, omit, or delete critical message headers, return paths, or IP addresses to conceal the origin of a message.
Transmit viruses, worms, Trojan horses, or engage in any form of denial-of-service attacks.
Engage in hacking, unauthorized access, or any other activity that compromises the security of The TKS Group Services or any connected system.
Solicit or promote illegal activities, including the transmission of unsolicited bulk emails (spam).
Download, publish, or distribute copyrighted materials without the necessary authorization or legal basis.

9. Security Violations and Network Abuse


You may not use our Services to compromise the security or integrity of any network, system, or application. This includes unauthorized access, port-scanning, or vulnerability testing on networks or devices for which you do not have permission. The TKS Group reserves the right to immediately suspend or terminate any account involved in such activities.

10. U.S. Export Controls

Use of The TKS Group Services is governed by U.S. export control laws, regardless of the user’s location. These laws may restrict the export or sale of certain products or services to designated countries or individuals. It is your responsibility to comply with these laws.
